Information for CB PLATINA’s clients
In connection with the requests from clients making money transfers via the CyberPlat System, the Bank of Russia hereby notifies you of the following.
By its Order No. OD-1938, dated 17 September 2021, the Bank of Russia revoked the banking licence of the Moscow-based Commercial Bank PLATINA LTD (Reg. No. 2347; hereinafter, the Bank). The Bank of Russia appointed a provisional administration1 to the Bank. In accordance with federal laws, the powers of the credit institution’s executive bodies were suspended.
Pursuant to Russian laws,2 after the revocation of its licence, the Bank lost the right to carry out any banking operations, including those for processing payments made to payees via the CyberPlat System.
The Bank of Russia notes that, pursuant to Article 37 of the Federal Law ‘On Consumers’ Rights Protection’, a consumer’s obligations to a seller (contractor) to pay for goods (works, services) are deemed to have been fulfilled in the amount paid since the moment of making the related cash payment to the seller (contractor), or a credit institution, or a payment agent accepting payments from individuals, or a bank payment agent (subagent) operating according to the law on banks and banking activities, as relevant.
Currently, the provisional administration is forming a register of payments accepted via the CyberPlat System, but not credited to the actual payees, in order to notify the latter that the payers fulfilled their obligations.
However, no information on the Bank’s obligations that were not performed via the CyberPlat System, which was requested by the provisional administration from the CYBERPLAT Company responsible for information technology communication between the CyberPlat System participants, has been provided.
To identify a relevant creditor on transactions conducted via the CyberPlat System, the clients and/or payees may request information from the Bank, where needed, by sending an application to the address: 12 Krasnopresnenskaya Naberezhnaya, 123610 Moscow.
