On documents required for deposit compensation payments
The Bank of Russia receives inquiries from the general public regarding payments of insurance compensations for deposits in certain banks the banking licence of which was revoked.
We state that according to Articles 10 and 12 of Federal Law No.
- Application in the form determined by the state corporation Deposit Insurance Agency;
- Personal identity documents; successors must additionally present documents confirming their rights for succession or rights to use funds of the testator;
- Certified letter of attorney in case the application is made by a representative of the depositor (or successor).
If the bank does not possess documents confirming its liabilities to depositors, a depositor may be required to present additional documents as a justification of the claims:
- Bank deposit (account) agreement,
- Deposit receipt with bank’s stamps confirming the deposit of funds, an order from other bank confirming the transfer of funds to the depositor’s account or other document confirming the deposit of funds into the bank account in accordance with the requirements of the law, the banking rules stipulated by such law and normal business practice for banks, including the account statement of the depositor signed and stamped by the bank’s staff. The right to request account statement from the bank is set out by the current law.
Claims of the depositor can be justified by presenting solely the bank deposit (account) agreement only if such agreement includes a provision that by signing it both parties confirm the deposit of funds into the bank account.
